Second, we’re members of The Property Ombudsman, which unfortunately many property companies are not. This is worrying as it’s an easy way they could offer you more protection. We’re proud to be members and know it will give you added confidence in the service we offer.

1. Your Decision Guarantee

We promise not to hard sell, but we will extend that further. If you decide to invest you have a full 72 hours from allocation to consider your investment. If you change your mind you can pull out, simple!

2. Pay Back Guarantee

We want to wow you with our service from the moment you start working with us. So if you feel wowed and recommend us to your friends and family, we’ll refund 100% of your initial consultancy fee, once you’ve referred four people to us.

Talk is cheap unless you are prepared to back it up

Being told that property can change your life is exciting but you shouldn’t take excessive risks. Working with a reputable property company is one of the ways you can accelerate your success but equally working with a dodgy property company could seriously damage your wealth. Please make sure you do your due diligence wisely on any investment and any investment company you choose to work with.

Pay Back Guarantee

  • The Pay Back Guarantee will only be paid after four referrals have paid consultancy fees for their own investments.
  • The refund of your consultancy fee is for the first property you buy with us only.

General T&Cs

  • Property Hub signed reservation form must be returned to us within 72 hours.
  • If a developer reservation form is required, this must be completed, signed and returned to us within 3 working days of request.
  • Reservation Deposits and Consultancy Fees must be paid within 3 working days of request.
  • Clients must advise us of their intent to withdraw from a deal within 5 working days of advising their solicitor.

Where to find information about us and our services.

You can find everything you need to know about us, Property Hub Invest Limited, and our services, on our website at https://propertyhub.net or from our Portfolio Managers before you enter into this contract.

We also refer you to the information in relation to the Development you have already been sent, including the Property Hub Invest Limited Information Page, as well as the launch webinar you have been invited to and may have attended in person, or online.

Our services in relation to your property purchase

Our Services:

We identify residential, buy-to-let investment opportunities, carrying out relevant due diligence on the Development and Developer. Our due diligence may include site visits and investigations/research into the geographical area in which the Development is located.

We undertake price negotiations with the Developer prior to us introducing the Development to you.

We prepare information packs on the investment opportunities, and our Portfolio Managers provide further information and answer questions on a 1-1 basis, as well as offering guidance on the purchasing process.

If, after reviewing an investment opportunity, you wish to proceed with reserving a property in the Development, we undertake a preliminary property-reservation process with you. Under this process, you make a Property-Reservation Request to us in relation to specific plot(s) in the Development. The details of your Property-Reservation Request are set out in the Purchase Information on page 1 of this document.

We then liaise with the Developer and notify them of your Property-Reservation Request, which may include passing them your contact details. This then starts the first stage of your property purchase process with the Developer.

Only the Developer can make, and confirm, your Property-Reservation, and not Property Hub Invest Limited. More detail on this process is set out below in the section entitled: [“Acceptance by us of your Property-Reservation Request is no guarantee that the Developer will honour that Property-Reservation”].

When you make a Property-Reservation Request to us you are agreeing that*:

  • On occasion, there may be reason for us, Property Hub Invest Limited, to reject your Property-Reservation Requests – for example, should a buyer not pass a KYC check
  • If we reject your reservation request, your Property Hub Invest Limited Fee will be returned
  • Acceptance by us of your Property-Reservation Request is no guarantee that the Developer will honour that Property-Reservation.
  • If the developer rejects your reservation request, we offer a full refund of the Property Hub Invest Limited Fee.
  • We charge you a non-refundable Property Hub Invest Limited Fee for our Services when you make a Property-Reservation Request that is accepted by the developer.
  • We offer a 72-hour cooling-off period from initial reservation request.
  • We’re not responsible for issues outside of our control, for example changes to lenders’ criteria or government legislation
  • If your Property-Reservation falls away for any reason, Property Hub Invest Limited is entitled to market the property again.
  • You may incur additional costs in relation to buying and managing a property; for example, fees to your Solicitor and other advisors
  • You are responsible for your own investment decisions. We recommend seeking the advice of a competent independent financial advisor prior to making any financial decision.
  • You understand the key risks.
  • You believe the property purchase is affordable, based on your personal circumstances and financial assessments
  • We may receive Introducer Fees, agency fees and commissions · We have refund payment arrangements, where applicable.
  • You have rights if there is something wrong with the services you receive from us.
  • We can revise the services we provide and these Terms & Conditions, if there are changes in relevant laws and regulatory requirements
  • If we break our obligations under these Terms & Conditions, there are certain losses we won’t compensate you for, for example, if a loss could have been avoided had you taken reasonable action.
  • We use your personal data as set out in our Privacy Notice.
  • You give us permission to pass your details to third parties in connection with the provision of our services under this contract, and in connection with the purchase and ongoing management of your property.
  • VAT is payable where applicable.
  • You have several options for resolving disputes with us.
  • Other important terms apply to these Terms & Conditions. A full list of which is outlined in the proceeding section

Sometimes we reject Property-Reservation Requests

Sometimes we reject Property-Reservation Requests and do not pass the details to the Developer. This could happen, for example, if a customer fails our Know Your Client checks or we are unable to verify customer details provided to us. When this happens, we let you know as soon as possible and return our Property Hub Invest Limited Fee if you have already paid it to us.

Acceptance by us of your Property-Reservation Request is no guarantee that the Developer will honour that Property-Reservation

We process your Property-Reservation Request and pass the details to the Developer.

Following receipt of your Property-Reservation Request, the Developer may provide you with further information and their terms and conditions. These may include a requirement to pay them a reservation fee to secure your Property-Reservation, and/or that you proceed to exchange of contracts for the purchase of the property within a time period set by the Developer.

You (or your solicitors) will deal directly with the Developer (or their solicitors) to finalise and confirm your Property-Reservation. We do not represent, or act for, the Developer, and only the Developer, not Property Hub Invest Limited, is able to confirm the Property-Reservation.

The Property-Reservation will be done under a separate arrangement / contract between you and the Developer. You will also deal directly with the Developer (usually via solicitors) in relation to exchanging contracts for, and completing the purchase of, the property.

Whilst the Property Hub Invest Care Team will keep in touch with you during the process, after we have passed the Property-Reservation Request to the Developer, we have no further responsibility for the progress of the property purchase.

We offer a full refund of the Property Hub Invest Limited Fee, if your Property Reservation request is rejected by the developer

If the Developer determines that, through no fault of yours, it is unable to accept the reservation request on the property you specifically asked to reserve with them, and you choose not to purchase an alternative property if the Developer offers you one, then you may terminate this contract with us. If this contract is terminated under those circumstances, we will refund the Property Hub Fee in full.

We offer a cooling-off period

If you notify us in writing within 72 hours from making payment of the Property Hub Invest Limited Fee, that you have changed your mind and wish to cancel the contract and withdraw your Property-Reservation, then we will refund your Property Hub Invest Limited Fee in full.

We charge you a non-refundable Property Hub Invest Limited Fee for our Services, when you make a Property-Reservation Request that is accepted by the developer.

The Property Hub Invest Limited Fee [which is noted in the “Property Information” on page 1 of this document] is payable in respect of the Services provided to you by Property Hub Invest.

These Services are set out above, in the section entitled [“Our services in relation to your Property purchase”].

We’re not responsible for issues outside of our control

We are not responsible for, and will not compensate you for, events that are outside of our control, even if they affect your investment decision or your property (or its purchase).

Things outside of our control may include:

  • Any matter arising from changes in lenders’ criteria or interest / mortgage rates, legal precedent, government legislation or changes in the market (including to property prices), or
  • Activities of the Developer or issues regarding the Development (including in connection with the building / development of the Development or your property), or any issues, delays or failures in the progression of exchange or completion of contracts for your property purchase, or
  • Events such as Act of God, pandemic or epidemic including the Coronavirus outbreak or quarantine restrictions, or natural disasters such as storms, earthquakes, tidal waves, floods, droughts, lightning, explosions, fires, or destruction of plant, machinery and/or premises, war, riot, terrorism, acts of sabotage, failure of power supply, lock-out, strike or other action taken by workers in contemplation or furtherance of a dispute or owing to any inability to procure necessary materials and/or services.

The circumstances in which you are entitled to a refund of the Property Hub Invest Limited Fee, are set out elsewhere in these Terms & Conditions, in the sections entitled “We offer a cooling-off period / We offer a full refund of the Property Hub Fee, if your reserved Property becomes unavailable.” Other than in these specified circumstances, we will not refund the Property Hub Fee.

If your Property-Reservation falls away, Property Hub Invest Limited is entitled to market the property again

If the Developer informs us that your Property-Reservation Request has been rejected or the Property Reservation with them has terminated, expired or falls away for any reason and the sale and purchase of the property to you will not proceed, Property Hub Invest Limited is entitled to market that property to other potential customers.

You may incur additional costs in relation to buying and managing a property

In addition to the Property Hub Invest Limited fee payable to us, you may incur additional costs payable to other organisations in relation to buying the property, including fees and costs payable to the Developer, your solicitors and other advisers, costs in connection with obtaining a mortgage, and taxes.

Following the purchase of your property, you may also incur costs in relation to running and maintaining your property. Any information we provide to you in relation to potential additional costs (i.e. costs in addition to the Property Hub Invest Limited Fee) are provided for information purposes only and should not be relied upon.

We cannot be held liable for, and accept no responsibility for, any costs associated with the purchase, running or maintenance of your property, whether these were identified by us in any documentation or information provided to you, including any cash-flow forecast. We are responsible solely for the Services set out in the section entitled [“Our services in relation to your property purchase”].

In particular, should the purchase of your property from the Developer not proceed, you (and not Property Hub Invest Limited), will be responsible for meeting any and all costs (including future costs).

You are responsible for your own investment decisions. We recommend seeking the advice of a competent independent financial advisor prior to making any financial decision

You are responsible for your own investment research and due diligence (including in relation to the geographical area and comparable market rents), and your investment and purchasing decisions.

You should not rely on our webinars, presentations, accompanying documentation or information in connection with the Developer, Development and/or the property. All photos and figures quoted by us or otherwise provided to you, are for illustrative purposes only.

You accept that whilst Property Hub Invest Limited presents various possible structures to purchase property, we do not provide advice on these structures, including their suitability, and we cannot be held responsible for them.

You agree that Property Hub Invest Limited, its directors, employees and shareholders have given no advice as to the suitability of any property purchase or investment, including the property. Any news, information, or any material published or provided in any media by Property Hub Invest or any company in the Property Hub group of companies is provided for information only, and any opinions expressed should not be relied upon when making investment / purchase decisions; and you agree that Property Hub Invest shall not be liable for any decision made or action taken (including in relation to making the Property-Reservation Request), based upon reliance on any such opinions, news, information or material.

We make no claims as to the specification of the finished property. Prior to finalising your purchase, you will need to refer to information provided to you by the Developer, including their specifications for the relevant property.

Where you had questions or were unsure, you confirm that prior to making the Property-Reservation Request you consulted a competent independent adviser and that those questions have been answered to your full satisfaction.

You acknowledge that you have reviewed the cash flow illustrations which can be accessed via the Property Hub Invest Information Page, and through your own due diligence and analysis (and any independent advice you have sought) you believe that the purchase and service of the property on an ongoing basis, is within your financial means.

You understand the key risks

You are aware, prior to making your Property-Reservation Request, that a buy-to-let investment involves certain financial risks. These may include:

  • Property values and rents can go down as well as up.
  • There can be no assurance that your property purchase will achieve your investment objective. In particular, a property investment is inherently illiquid and market conditions may impact your returns.
  • Actual inflation or interest rates may be higher than estimates or projections, and lenders’ criteria and/or the availability of mortgage products may fluctuate.
  • Costs associated with managing your property may change over time.
  • If you do not keep up payments on loans or mortgages secured on your property, it may be repossessed.
  • The purchase of a buy-to-let property is not within a financially regulated framework and therefore may be considered as a high-risk investment.

We may receive introducer fees, agency fees and commissions

We may receive introducer fees, agency fees, and/or commissions. These can include fees from developers and other third parties.

We have refund payment arrangements

Where a refund of the Property Hub Fee is payable under this contract, we will refund you as soon as possible. We will refund you by the method you used for payment. We don’t charge a fee for the refund.

Although the payment instructions will be made by us as soon as possible, you should be aware that there may be a delay in you receiving the refund, where the payment is processed by third parties outside of our control, such as your credit card supplier.

You have rights if there is something wrong with the services you receive from us

If you think that there is something wrong with the services you have been provided by Property Hub Invest, or that the property or purchasing opportunity does not conform to information provided to you by us, you should contact our Property Hub Invest Care Team on 020 3322 9493 or at [email protected] .

Remember too, that you have several options for resolving disputes with us, which are detailed in the below section entitled “You have several options for resolving disputes with us”.

We can revise the services we provide, and these Terms & Conditions, if there are changes in relevant laws and regulatory requirements

We can always change our services to reflect changes in relevant laws and regulatory requirements, and to make minor technical adjustments and improvements.

If we break our obligations under these Terms & Conditions, there are certain losses we won’t compensate you for

We’re responsible for losses you suffer caused by us breaking our obligations under this contract, unless the loss is:

  • Unexpected. It was not obvious that it would happen and nothing you said to us before you made your Property-Reservation meant we should have expected it (so, in the law, the loss was unforeseeable, indirect or consequential).
  • Caused by a delaying event outside our control. Further information is set out in the section entitled [“We’re not responsible for delays outside our control.”]
  • Avoidable. Something you could have avoided by taking reasonable action.
  • A business loss. It relates to your use of our Services for the purposes of trade, business, craft or profession.
  • Loss of profit. It relates to the loss of profits, business, or opportunity.

Our liability is limited to the amount of the Property Hub Fee.

However, nothing shall limit or exclude our liability if to do so is not permitted by law.

We use your personal data as set out in our Privacy Notice

As part of our Services, we may provide your details to the Developer in order to progress your Property-Reservation and the purchase of your property.

Additionally, your details may be referred to other third parties who supply a number of different services in connection with the purchase and ongoing management of the Property, including (but not only) mortgage brokers, solicitors, letting agents, snagging companies, and blinds, furniture and flooring contractors.

Our policy complies with UK law accordingly implemented, including that required by the EU General Data Protection Regulation (GDPR).

You give us permission to pass your details to third parties in connection with the provision of our services under this contract, and in connection with the purchase and ongoing management of your property.

VAT is payable

If applicable, VAT will be charged at the prevailing rate. This will be the case whether or not reference to VAT is included on the cashflow documentation, quote, order or invoice.

You have several options for resolving disputes with us

If you are not satisfied with the outcome, you can lodge a complaint with The Property Ombudsmen Scheme at : http://www.tpos.co.uk.

You can go to court. These terms (and any non-contractual disputes or claims) are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

Other important terms apply to these Terms & Conditions

We can transfer our contract with you, so that a different organisation is responsible for supplying your services. We’ll tell you in writing if this happens and we’ll ensure that the transfer won’t affect your rights under the contract. If you’re unhappy with the transfer, you can contact our Care Team on 020 3322 9493 or at [email protected].

You can only transfer your contract with us to someone else if we agree to this. We are under no obligation to agree to you transferring your contract.

Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you’re not allowed to, but that doesn’t mean we can’t do it later.
